Compensation
220 Compensation
(1) A person bound by an order under this part who suffers loss because of the
making of the order may apply to the chief executive for compensation if the
person considers that there were insufficient grounds for the making of the
order.
(2) If there were insufficient grounds for the making of the order,
the chief executive must pay the compensation to the applicant that is just
and reasonable.
(3) The chief executive must give notice about his or her
decision about the payment of compensation under this section to each
applicant for the payment of the compensation.
(4) If the chief executive has
not decided an application for compensation under this section within 28 days
after receiving the application, the chief executive is taken to have decided
to refuse to pay any compensation.
(5) If the chief executive refuses an
application for compensation or decides an amount of compensation less than
that sought by the applicant, the notice must be a QCAT information notice.
