Alternative verdicts for particular offences
252 Alternative verdicts for particular offences
(1) If, on the trial of a person charged with an offence against section 32 ,
the trier of fact is not satisfied the person committed the offence but is
satisfied the person committed an offence against section 35 (1) — (a) the
trier of fact may find the person not guilty of the offence charged but guilty
of an offence against section 35 (1) ; and
(b) the person is liable to be
punished for that offence.
(2) If, on the trial of a person charged with an
offence against section 33 , the trier of fact is not satisfied the person
committed the offence but is satisfied the person committed an offence against
section 35 (2) — (a) the trier of fact may find the person not guilty of the
offence charged but guilty of an offence against section 35 (2) ; and
(b) the
person is liable to be punished for that offence.
(3) If, on the trial of a
person charged with an offence against section 164E (3) , the trier of fact is
not satisfied the person committed the offence but is satisfied the person
committed an offence against section 164E (4) — (a) the trier of fact may
find the person not guilty of the offence charged but guilty of an offence
against section 164E (4) ; and
(b) the person is liable to be punished for
that offence.
