Handling and sale of unsuitable food
36 Handling and sale of unsuitable food
(1) A person must not handle food intended for sale in a way that will make,
or is likely to make, the food unsuitable. Penalty— Maximum
penalty—400 penalty units.
Note— This provision is an executive liability provision—see section 260
.
(2) A person must not sell food that is unsuitable. Penalty—
Maximum penalty—400 penalty units.

(3) For the purposes of this section, it is immaterial whether the food
concerned is safe.
