Application for renewal
72 Application for renewal
(1) A licensee may apply to the local government that issued a licence for
renewal of the licence.
(2) The application must— (a) be made within 60
days before the licence ends; and
(b) comply with section 85 .
(3) The local
government must consider the application and decide to renew, or refuse to
renew, the licence.
(4) In deciding the application, the local government may
have regard to— (a) the matters to which the local government may have
regard in deciding whether an applicant for a licence is a suitable person to
hold the licence and whether the premises under a licence are suitable for
carrying on a licensable food business; and
(b) the results of audits of an
accredited food safety program for the food business under the licence; and
(c) the results of inspections to monitor compliance with this Act during the
current term of the licence.
(5) If the local government decides to refuse to
renew the licence, or impose conditions on the licence, the local government
must as soon as practicable give the licensee an information notice for the
decision.
(6) A licence may be renewed by issuing another licence to replace
it.
