General power to seize goods
91A General power to seize goods
(1) This division applies if an inspector reasonably believes goods have been
supplied in contravention of this Act, other than a relevant offence provision
under section 87 .
(2) The inspector may seize enough of the goods— (a) to
decide whether the contravention has happened; or
(b) to be used as evidence
in a proceeding under this Act about the contravention. Example of operation
of paragraph (a)— An inspector may seize a quantity of fabric to test its
fibre content and to work out whether its labelling complies with the
prescribed information standard about fibre content.
(3) If the goods are
in a container and it is not practicable to seize them without the container,
the inspector may seize the container and its contents.
