Inquiries about appropriateness and competence
18 Inquiries about appropriateness and competence
(1) The tribunal, or the registrar acting either at the direction of the
tribunal or on the registrar’s own initiative, may make inquiries about the
appropriateness and competence to perform functions and exercise powers under
an appointment order of a person who has agreed to a proposed appointment or
who is a guardian or administrator.
(2) If asked by the tribunal or
registrar, the commissioner of the police service must give the tribunal or
registrar a written report about the criminal history of— (a) a person who
has agreed to a proposed appointment; or
(b) a person who is a guardian or
administrator; or
(c) if the person mentioned in paragraph (a) or (b) is a
corporation—a director, secretary or person involved in the management,
direction or control of the corporation.
(3) If the registrar makes the
inquiries, the registrar must advise the tribunal of the results of the
inquiries before the tribunal makes an appointment order.
