Criminal history report
36 Criminal history report
(1) This section applies for deciding if a person— (a) is disqualified from
becoming a member under section 33 ; or
(b) may be removed as a member of the
board under section 34 .
(2) The chief executive may ask the commissioner of
the police service for a written report about the criminal history of the
person that includes a brief description of the circumstances of a conviction
mentioned in the criminal history.
(3) However, the chief executive may make
the request only if the person has given the chief executive written consent
for the request.
(4) The commissioner of the police service must comply with
the request.
(5) However, the duty to comply applies only to information in
the commissioner’s possession or to which the commissioner has access.
