Deciding whether person ought reasonably to have known something
632 Deciding whether person ought reasonably to have known something
(1) This section applies in relation to a proceeding for an offence against
this Law if it is relevant to prove that someone ought reasonably to have
known something.
(2) A court may consider the following when deciding whether
the person ought reasonably to have known the thing— (a) the person’s
abilities, experience, expertise, knowledge, qualifications and training;
(b)
the circumstances of the offence;
(c) any other relevant matter prescribed by
the national regulations for the purposes of this section.
