(1) The commission may make an order under this part on application by—(a) an employee to be covered by the order; or(b) an organisation whose rules entitle it to represent the industrial interests of employees to be covered by the order; or(c) a State peak council; or(d) the Minister; or(e) the human rights commissioner under the Anti-Discrimination Act 1991 .
(2) Also, the commission must make an order under this part on its own initiative if required to do so under section 249 .
