(1) This section applies if—(a) an employee has made an application under section 273 ; and(b) the commission is satisfied that—(i) the employee has been bullied in the workplace; and(ii) there is a risk that the employee will continue to be bullied in the workplace.
(2) The commission may make any order it considers appropriate (other than an order requiring payment of a pecuniary amount) to prevent the employee from being bullied in the workplace.
(3) In considering the terms of an order, the commission must take into account—(a) if the commission is aware of any final or interim outcomes arising out of an investigation into the matter that is being, or has been, undertaken by another entity—those outcomes; and(b) if the commission is aware of any procedure available to the employee to resolve grievances or disputes—that procedure; and(c) if the commission is aware of any final or interim outcomes arising out of any procedure available to the employee to resolve grievances or disputes—those outcomes; and(d) any other matter the commission considers relevant.
