(1) The commission may make an order about severance allowance or other separation benefits on application by—(a) an employee; or(b) an organisation whose rules entitle it to represent the employee’s industrial interests.
(2) An employer must not contravene the order.
(3) If an employer contravenes the order, the commission may—(a) make any of the orders it may make under section 321 (2) , (3) or (4) ; or(b) order the employer to pay the employee an amount of not more than the monetary value of 135 penalty units.
(4) In this section—
"severance allowance or other separation benefits" means severance allowance or other separation benefits under article 12 of the Termination of Employment Convention 1982.
