(1) An
"independent courier" is a person who provides a service transporting goods using a courier vehicle if, in the course of providing the service, the courier vehicle is driven only by—(a) if the person is an individual—the individual; or(b) if the person is a partnership—a partner in the partnership; or(c) if the person is a corporation—(i) an executive officer of the corporation; or(ii) a member of the family of an executive officer of the corporation.
(2) It does not matter whether—(a) a person mentioned in subsection (1) (b) or (c) is employed by the independent courier or engaged in another way; or(b) a person other than the independent courier is temporarily employed, or temporarily engaged in another way, to provide the service, and drive the courier vehicle in the course of providing the service, while the independent courier is sick, taking leave or otherwise temporarily unavailable.
(3) In this section—
"drive" , a courier vehicle, includes ride the vehicle.
"executive officer" , of a corporation, means a person who is concerned with, or takes part in, the corporation’s management, whether or not the person is a director or the person’s position is given the name of executive officer.
