(1) This section applies if—(a) a person (the proposer) gives notice under section 406W of the proposer’s intention to start negotiating with a view to making negotiated agreement; and(b) a person who receives the notice wants to be a party to the negotiations.
(2) The person must give written notice of the person’s intention to be a party to the negotiations to—(a) the proposer; and(b) the commission.
(3) A notice under subsection (2) must be given within 21 days after the person receives the proposer’s notice under section 406W .
(4) An agreement proposed to be a negotiated agreement may only be made during the period mentioned in subsection (3) if notice of intention to be a party to the negotiations has been given under subsection (2) by—(a) each proposed party to the negotiations; and(b) each relevant employee organisation for the proposed agreement.
