(1) This section applies if a relevant member performs the functions of the office on a part-time basis under an appointment or agreement.
(2) For the pensions Act , sections 3 , 4 and 5 , the period served by the relevant member is taken to be the total number of years, including any part of a year, that the person serves as a relevant member regardless of whether the person performs the functions of the office on a full-time or part-time basis.
(3) For the Pensions Act , sections 3 , 4 and 5 , the salary of the relevant member is taken to be the amount worked out using the formula— where—
"FTS" means the salary payable to a relevant member who performs the functions of the office on a full-time basis under section 586 .
"PS" means the sum of the period served on a full-time basis and each period of equivalent full-time service of the relevant member.
"TS" means the total number of years, including any part of a year, that the person serves as a relevant member regardless of whether the person performs the functions of the office on a full-time or part-time basis.Example of TS—A person works as a commissioner full-time for 5 years 6 months and then works part-time on a 50% part-time basis for 5 years. The TS of the person is 10 1 / 2 years (5 1 / 2 years plus 5 years).
(4) The amount of the salary of the relevant member worked out under subsection (3) is to be worked out to 2 decimal places and rounded up or down to the nearest whole dollar amount.
(5) If the sum of the period served on a full-time basis and each period of equivalent full-time service for a relevant member is 10 years or more—(a) subsection (3) does not apply to the relevant member for the Pensions Act , sections 3 , 4 and 5 ; and(b) the salary of the relevant member for the Pensions Act , sections 3 , 4 and 5 is taken to be the salary payable to a relevant member who performs the functions of the office on a full-time basis under section 586 .
(6) In this section—
"equivalent full-time service" , for each period of part-time service, means the period of service multiplied by the percentage of full-time service represented by the part-time service stated in the appointment or agreement.
