A person convicted of a disqualifying offence may be a candidate or elected to an office in an organisation only if—
(a) the person has made an application under subdivision 2 for leave to hold the office and—(i) was given leave to hold the office; or(ii) the court fixed a disqualification period for the person and the period has ended; or
(b) 5 years has elapsed since the later of the following—(i) the conviction;(ii) if the person served a prison term for the offence—the person’s release from prison.
