Costs in proceedings by members against primary thoroughfare body corporate
131 Costs in proceedings by members against primary thoroughfare body
corporate
(1) In any proceedings brought by any member against the primary thoroughfare
body corporate, the court before which the proceedings are brought may order
that any moneys (including costs) payable by the primary thoroughfare body
corporate pursuant to an order of the court made in those proceedings shall be
paid, only in respect of such members as are specified in the order and in
such proportions as may be so specified, by the primary thoroughfare body
corporate out of contributions levied for the purpose.
(2) Where a court
makes an order under subsection (1) the primary thoroughfare body corporate
shall, for the purpose of paying the moneys ordered to be paid by it, levy
contributions in accordance with the terms of the order and shall pay the
moneys out of the contributions paid pursuant to that levy.
(3) The
provisions of section 109 with such modifications as may be necessary apply to
and in respect of contributions levied under subsection (2) in the same way as
those provisions apply to contributions levied under that section.
