INTEGRATED RESORT DEVELOPMENT ACT 1987 - SECT 147
Power of entry
147 Power of entry
(1) For the purpose of carrying out— (a) any work required to be carried out
by the principal body corporate by a notice served on it by a public authority
or local government; or
(b) any work referred to in section 151 (1) (b) ;
the
principal body corporate may, by its agents, servants or contractors, enter
upon any part of the secondary thoroughfare for the purpose of carrying out
the work— (c) in the case of an emergency—at any time; or
(d) in any
other case—at any reasonable time on notice given to any occupier of a lot
likely to be affected thereby.
(2) For the purposes of subsection (1) (d) ,
an occupier of a lot, being a lot on a group titles plan or a building units
plan, shall be taken to have been given notice if the notice is duly given to
the body corporate incorporated by the registration of that plan.
(3) A
person shall not obstruct or hinder the principal body corporate in the
exercise of its power under subsection (1) . Penalty— Maximum penalty
for subsection (3) —50 penalty units.
