Notice of non-compliance for fundraising event
14C Notice of non-compliance for fundraising event
(1) This section applies in relation to a fundraising event held by an entity
purporting to rely on section 13 if, at any time during the event, an
investigator or police officer considers the entity does not qualify for the
exemption under that section.
(2) The investigator or police officer may give
a notice (a
"non-compliance notice" ) to any of the following— (a) the entity;
(b) the
person who appears to be in charge of the sale of liquor at the event;
(c) a
person selling liquor at the event.
(3) The notice must state— (a) that the
investigator or police officer believes the sale of liquor at the event is not
exempt from this Act under section 13 ; and
(b) the reason for the
investigator’s or police officer’s belief; and
(c) that a failure to
qualify for the exemption under section 13 means the entity may be prosecuted
for breaching 1 or more provisions of this Act; and
(d) either— (i) the
action the investigator or police officer considers must be taken to qualify
for the exemption under section 13 ; or
(ii) that the sale of liquor must
cease immediately.
