Power to require land management agreement in particular circumstances
176UA Power to require land management agreement in particular circumstances
(1) This section applies for a term or perpetual lease if— (a) the lease is
for rural leasehold land; and
(b) the Minister is satisfied— (i) the lease
land suffers from, or is at risk of, land degradation; or
(ii) the lessee is
using the lease land in a way that is not fulfilling the lessee’s duty of
care for the land, under section 199 .
(2) The Minister, by notice, may
require a land management agreement to be entered into for the lease land.
(3) If a land management agreement is entered into under this section the
lease is subject to a condition that the lessee must comply with the
agreement.
