Seizing evidence at a place that may be entered without consent or warrant
390ZG Seizing evidence at a place that may be entered without consent or
warrant
(1) An authorised officer who enters a place the authorised officer may enter
under this chapter without the consent of an occupier of the place and without
a warrant may seize a thing at the place if the authorised officer reasonably
believes the thing is evidence of— (a) the commission of an offence against
this Act; or
(b) a breach of a condition of a person’s lease, licence or
permit.
(2) However, if the authorised officer enters the place under
section 390N (1) (c) , (d) or (e) , the authorised officer may seize a thing
at the place only if the authorised officer also reasonably believes the
seizure is necessary to prevent the thing being— (a) hidden, lost or
destroyed; or
(b) used to commit, continue or repeat an offence against this
Act.
