The assessor may decide to take no further action about the conduct of a councillor if—
(a) the conduct was not the subject of a complaint made or referred to the assessor under division 2 ; and
(b) the assessor is satisfied—(i) the conduct does not constitute a conduct breach or misconduct; or(ii) there is insufficient information to properly investigate the conduct or form an opinion about whether the conduct is, or may be, a conduct breach or misconduct; or(iii) taking further action would be an unjustifiable use of resources; or(iv) taking further action would not be in the public interest.
