LOCAL GOVERNMENT ELECTORAL ACT 2011 - SECT 200D
Terminating election
200D Terminating election
(1) This section applies if— (a) the election is suspended under
section 200B ; and
(b) in consultation with the electoral commission, the
Minister is satisfied— (i) the period of the suspension of the election is
likely to compromise the outcome of the election; and
(ii) it would be
practicable to hold a new election.
(2) The Minister must, by notice
published on the electoral commission’s website, terminate the election.
(3) On the publication of the notice— (a) nominations for the election are
taken to have been withdrawn; and
(b) the following items for the election
must be destroyed— (i) declaration envelopes;
(ii) ballot papers in ballot
boxes;
(iii) unused ballot papers;
(iv) all books and papers, other than the
voters roll, used by each presiding officer; and
(c) all deposits given to
the returning officer under section 39 for the election must be refunded.
(4)
The Minister must, in consultation with the electoral commission and having
regard to the purpose of this part, fix a day that is a Saturday for the
holding of the quadrennial election for 2020.
