Re-counting of votes
96A Re-counting of votes
(1) At any time before the following happens, the electoral commission may
direct the returning officer, or another member of the electoral
commission’s staff, to re-count some or all of the ballot papers for an
election— (a) the result of the poll for the election is notified by the
electoral commission under section 100 ;
(b) the electoral commission refers
a matter to the Court of Disputed Returns under part 7 .
(2) The returning
officer may re-count some or all of the ballot papers for the election at any
time before the results of the election are notified.
(3) A person carrying
out a re-count of ballot papers must, so far as practicable, ensure that the
requirements of section 95 are complied with.
(4) This section does not limit
by implication section 9 (5) .
