Foreign lawyer employing Australian legal practitioner
173 Foreign lawyer employing Australian legal practitioner
(1) An Australian-registered foreign lawyer may employ 1 or more Australian
legal practitioners.
(2) Employment of an Australian legal practitioner does
not entitle an Australian-registered foreign lawyer to practise Australian law
in this jurisdiction.
(3) An Australian legal practitioner employed by an
Australian-registered foreign lawyer may practise foreign law.
(4) An
Australian legal practitioner employed by an Australian-registered foreign
lawyer must not do either of the following— (a) provide advice on
Australian law to, or for use by, the Australian-registered foreign lawyer;
(b) otherwise practise Australian law in this jurisdiction in the course of
that employment.
(5) Subsection (4) does not apply to an Australian legal
practitioner employed by a law firm, a partner of which is an
Australian-registered foreign lawyer, if at least 1 other partner is an
Australian legal practitioner.
(6) Any period of employment of an Australian
legal practitioner by an Australian-registered foreign lawyer can not be used
to satisfy a requirement imposed by a condition on a local practising
certificate to complete a period of supervised legal practice.
