377 Time limit for making claims following advertisement
(1) This section applies if the law society publishes a notice under
section 376 fixing a final date after which claims relating to a default of a
law practice can not be made.
(2) A claim may be made— (a) up to and
including the final date fixed under the notice; or
(b) within a further
period allowed by the law society; or
(c) if the tribunal allows a further
period after the law society refuses to do so—within the period allowed by
the tribunal.
(3) A claim may be made under subsection (2) even though it
would have been barred under section 375 had the notice not been published.
(4) The tribunal or law society may allow a further period mentioned in
subsection (2) only if satisfied that— (a) it would be reasonable to do so
after taking into account all ascertained and contingent liabilities of the
fidelity fund; and
(b) it would be appropriate to do so in the particular
case having regard to matters the tribunal or law society considers relevant.
