Application of part to audits and investigations
570 Application of part to audits and investigations
(1) This part applies to each of the following— (a) an audit conducted under
section 130 ;
(b) an investigation under this Act relating to the
trust accounts of an incorporated legal practice;
(c) an investigation
relating to a complaint made under this Act involving legal services provided
by an incorporated legal practice, however that complaint is expressed.
(2)
This section does not limit the powers under chapter 4 in relation to a legal
practitioner director, or an associate, of an incorporated legal practice.
(3) A person conducting an audit or investigation to which this part applies
may exercise the powers set out in this part for the audit or investigation.
(4) For subsection (3) , in addition to the matters mentioned in section 548
(1) , a magistrate may issue a warrant for a place if the magistrate is
satisfied that an ILP investigator has been unreasonably refused entry to the
place for an audit as mentioned in subsection (1) (a) and the provisions of
this chapter about warrants apply with necessary changes.
(5) A regulation
may provide for how the provisions about warrants apply in relation to the
issue of a warrant for an audit, and related matters.
