(1) The following persons may apply to the tribunal for an authority (an
"examination authority" ) for another person—(a) the administrator of an authorised mental health service;(b) a person authorised in writing by the administrator of an authorised mental health service to make an application under this section;(c) a person who has received advice, from a doctor or authorised mental health practitioner, about the clinical matters for the person who is the subject of the application.Note—See section 32 for the powers of a doctor or authorised mental health practitioner under an examination authority.
(2) The approved form for the application must include a statement by a doctor or authorised mental health practitioner about whether the behaviour of the person, or other relevant factors, could reasonably be considered to satisfy the requirements under section 504 (2) for making an examination authority for the person.Note—The application must be made in the approved form. See section 725 .
(3) In this section—
"clinical matters" , for a person, means—(a) general information about the treatment criteria, their application to the person, and whether there is a less restrictive way for the person to receive treatment and care for the person’s mental illness; and(b) whether the behaviour of the person, or other relevant factors, could reasonably be considered to satisfy the requirements under section 504 (2) for making an examination authority for the person; and(c) options for the treatment and care of the person; and(d) how the person might be encouraged to have a voluntary examination relating to the person’s mental illness.
