Decision on application for extension
147CB Decision on application for extension
(1) The Minister must decide to extend, or refuse to extend, the last renewed
term of the exploration permit.
(2) The Minister may decide to extend the
last renewed term of the exploration permit only if the Minister is
satisfied— (a) an exceptional event affecting the permit that occurred in
the last renewed term of the permit has prevented the holder of the permit
from carrying out the work program approved for the last renewed term of the
permit; and
(b) the holder has otherwise complied with this Act in relation
to the permit.
(3) The extended term is the term of not more than 3 years
decided by the Minister.
(4) The work program approved for the last renewed
term of the exploration permit applies for the extended term.
(5) The last
renewed term of an exploration permit may not be extended more than once.
