Minister’s power to decide excluded land
186AB Minister’s power to decide excluded land
(1) The Minister may decide excluded land for a mineral development licence.
(2) However, the power under subsection (1) may be exercised only when the
Minister is deciding whether to grant or renew the mineral development
licence.
(3) Excluded land must be within— (a) for the grant of a mineral
development licence—the area set out in the application for the mineral
development licence; or
(b) for the renewal of a mineral development
licence—the original area of the mineral development licence.
(4) Excluded
land may be described in a way the Minister considers appropriate, including,
for example, by area or by reference to a stated type of land.
(5) Land
ceases to be excluded land for a mineral development licence if the land is
relinquished or, for any other reason, ceases to be in the area of the mineral
development licence.
