215 Rights and obligations extended upon application for mining lease
(1) The holder of a mineral development licence who, during the term of the
licence makes application for the grant of a mining lease for any part of the
area of the licence, shall, during the period from the expiration of the
licence until the determination of the application, for so long as the
provisions of this Act and the terms and conditions that would apply if the
licence were current are complied with, have all the responsibilities, powers,
authorities and duties that the holder would have had for the part of the area
the subject of the application if the licence was current but during that
period no rental shall be payable under this part for the part of the area the
subject of the application.
(2) The entitlements of the holder of a mineral
development licence are not reduced or limited by reason only of the
holder’s application for the grant of a mining lease for any part of the
area of a mineral development licence.
