30 Rights and obligations extended upon application for mining claim etc.
(1) The holder of a prospecting permit who, during the term of the prospecting
permit, makes application for the grant of— (a) a mining claim; or
(b) a
mining lease;
in respect of any land in the area of the prospecting permit,
shall, during the period from the expiration of the prospecting permit until
the determination of the application, for so long as the provisions of this
Act and the terms and conditions that would apply if the permit were current
are complied with, have all the responsibilities, powers, authorities and
duties that the holder would have had in respect of the land the subject of
the application if the prospecting permit was current.
(2) The entitlements
of the holder of a prospecting permit are not reduced or limited by reason
only of the holder’s application for the grant of a mining claim or a mining
lease in respect of any land in the area of the prospecting permit.
