Effect of termination of mining lease
312 Effect of termination of mining lease
(1) This section applies on the termination of a mining lease.
(2) However,
this section does not apply to a mining lease if the termination is for
granting a mining claim or a new mining lease over the area of the terminated
lease to the holder of the terminated lease.
(3) The person who was the
holder of the terminated mining lease immediately before its termination must
immediately remove each post or other thing used to mark the land under this
Act (other than a survey mark or anything else required under another Act not
to be removed).
(4) On the termination of the mining lease, the ownership of
all mineral and property on the land in the area of the terminated lease
divests from the owner and vests in the State.
(5) However, subsection (4)
applies to property only if it was brought on to the land under the terminated
mining lease.
