National parks (recovery) taken to be national parks and special management areas (controlled action)
197 National parks (recovery) taken to be national parks and special
management areas (controlled action)
(1) On the commencement, the area of each national park (recovery)— (a)
continues as a national park under this Act as if it had been dedicated under
this Act as a national park; and
(b) is taken to be declared under this Act
as a special management area (controlled action) to allow activities of the
type, or for the purpose, stated in section 17(1A)(a)(i).
(2) As soon as
practicable after the commencement, the chief executive must— (a) erect or
display a notice for the special management area complying with the
requirements stated in section 42A(2); and
(b) publish a copy of the notice
on the department’s website and in the gazette.
(3) In this section—
"national park (recovery)" means an area that, immediately before the
commencement, was a national park (recovery) under this Act.
