Access determinations and part contributions of capital to fund installations or the construction of new facilities
164 Access determinations and part contributions of capital to fund
installations or the construction of new facilities
(1) In making an access determination, the relevant adjudicator for an access
dispute the subject of the determination may take into account past
contributions of capital to fund installations or the construction of new
facilities for the access dispute pipeline.
(2) Without limiting section 74 ,
the Rules may— (a) specify the matters that the relevant adjudicator must
address in making that access determination; and
(b) specify the content of
that access determination.
