Recovery of enforcement costs
72 Recovery of enforcement costs
(1) The State may recover from a
responsible person as a debt any reasonable costs incurred in taking the
enforcement action.
(2) Subsection (3) applies if— (a) the fortification
the subject of the enforcement action was removed in taking the action; and
(b) the removed fortification has been forfeited to the State under section 71
.
(3) Any net proceed from the fortification must be set off against the
amount of the debt.
