(1) A person who does an act or makes an omission with intent to hinder any of the following commits a misdemeanour—(a) the removal or modification of a fortification under a fortification removal order;(b) the taking of enforcement action.Penalty—Maximum penalty—5 years imprisonment.
(2) In this section—
"fortification removal order" only includes a fortification removal order if—(a) the order has taken effect; and(b) the period within which to file an appeal about the order has ended and—(i) no appeal about the order has been filed; or(ii) any appeal about the order has been withdrawn or dismissed.
"hinder" includes prevent, obstruct, interfere with and delay.
