PENALTIES AND SENTENCES ACT 1992 - SECT 195C
Confidentiality
195C Confidentiality
(1) A person who is a member of a community justice group must not— (a)
record or use information the person, or another person who is a member of the
community justice group, gains through performing a function under this Act,
or intentionally disclose it to anyone, other than under subsection (2) ; or
(b) recklessly disclose the information to anyone.
Penalty— Maximum
penalty—100 penalty units or 2 years imprisonment.
(2) A person who is a
member of a community justice group may— (a) record, use or disclose the
information if the recording, use or disclosure— (i) is done as part of
making submissions to the court under section 9 (2) (p) ; or
(ii) is
otherwise required or permitted by law; or
(b) disclose the information to
another member of the community justice group.
(3) In this section—
"disclose" information to someone else means— (a) orally disclose the
information to the other person; or
(b) produce to the other person, or give
the other person access to, a document containing the information; or
(c)
disclose the information to the other person in another way.
