General transitional provisions
204 General transitional provisions
(1) This Act applies to any sentence imposed after the commencement of this
section, irrespective of when the offence was committed.
(2) However, this
Act (the
"original Act" ) as in force immediately before the commencement of the
Penalties and Sentences Legislation Amendment Act 1993 (the
"amending Act" ) continues to apply to sentences imposed after the
commencement of the original Act and before the commencement of the
amending Act.
(3) An offender in relation to whom a sentence is in force
immediately before the commencement of this section continues to be subject to
the requirements of the sentence in all respects as if this Act had not been
enacted.
(4) A sentence mentioned in subsection (3) may be amended, and any
failure to comply with it may be dealt with, under this Act as it if were a
sentence imposed after the commencement of this section.
(6) For the purposes
of this section, a sentence imposed by an appeal court after the commencement
of this section, on setting aside a sentencing order made before the
commencement, is taken to have been imposed at the time the original
sentencing order was made.
(7) If an offender fails to comply with a
requirement of a sentence mentioned in subsection (3) that is not amended
under subsection (4) , the failure may be dealt with under this Act as if the
sentence were a sentence imposed after the commencement of this section.
