Failing to obey condition of recognisance
33A Failing to obey condition of recognisance
(1) If the court is satisfied that the offender has failed to obey a condition
of the recognisance, the court may forfeit the recognisance and issue a
warrant to arrest the offender.
(2) The warrant is to be directed to all
police officers to arrest and bring the offender before the court or a court
of like jurisdiction.
(3) The court before which the offender is brought
may— (a) sentence the offender for the offence with which the offender was
originally charged; or
(b) make another order that the court could lawfully
have made if the offender had not been released on recognisance.
