Fine limitations of certain courts
46 Fine limitations of certain courts
(1) If an Act creates an offence and does not provide a sentence, the maximum
fine that a court may impose for a single offence is— (a) if the court is a
Magistrates Court and the offender is— (i) an individual—165 penalty
units; or
(ii) a corporation—835 penalty units; or
(b) if the court is a
District Court and the offender is an individual—4,175 penalty units.
(2)
If an Act creates an offence and does not provide a sentence, there is no
limit on the fine that the court may impose for a single offence if— (a) the
court is a District Court and the offender is a corporation; or
(b) the court
is the Supreme Court.
