Enforcement of chief executive’s order
114 Enforcement of chief executive’s order
(1) A chief executive’s order may be enforced by the person in charge of the
public sector health service where the person to whom the order relates is to
be detained.
(2) The person in charge must before enforcing the order— (a)
give the person to whom the order relates a copy of the chief executive’s
order; and
(b) explain to the person, in general terms, the purpose and
effect of the chief executive’s order including that it is an offence not to
comply with the order.
(3) The person in charge must note on the copy and
original of the chief executive’s order when the copy was given to the
person.
(4) The person given a copy of the chief executive’s order under
subsection (2) (a) must comply with the order. Penalty— Maximum
penalty—200 penalty units.
(5) The person in charge of a public sector
health service may enforce a chief executive’s order with the help, and
using the force, that is reasonable in the circumstances.
(6) However, the
person in charge of a public sector health service must give the person
detained an opportunity to voluntarily comply with the order.
(7) A person
authorised by the person in charge of a public sector health service may help
the person in charge to enforce a chief executive’s order.
