Giving health information held by a health agency
173 Giving health information held by a health agency
(1) Subsection (2) applies if the chief executive, a person in charge of a
school, education and care service or QEC approved service, or another person
involved in the administration of this part asks for health information held
by a health agency to be provided to the chief executive, person in charge or
other person.
(2) A person asked to provide health information held by a
health agency under subsection (1) may give the information if the giving of
the information is necessary for the administration of this part.
(3)
Subsection (4) applies if a person in charge of a school, education and care
service or QEC approved service asks for information held by a health agency
about whether a child attending a school, education and care service or QEC
approved service has been vaccinated for a vaccine preventable condition.
(4)
The chief executive must provide the information to the person in charge if
the chief executive is satisfied that— (a) a child attending the school or
service is suspected of being at risk of contracting the vaccine preventable
condition if the child continues to attend the school or service; and
(b) the
information about the child is necessary to enable the person in charge to act
under section 165 or 166 .
(5) This section applies despite any other
provision of this Act or any provision of another law that deals with
confidentiality, including, for example, the
Hospital and Health Boards Act 2011 , section 142 .
