Directions to person in charge of school, education and care service or QEC approved service
180 Directions to person in charge of school, education and care service or
QEC approved service
(1) The chief executive may give a direction under subsection (3) to the
person in charge of a school, education and care service or QEC approved
service if the chief executive is satisfied there is an outbreak of a
contagious condition— (a) at the school or service; or
(b) in the community
and there is a risk of children and staff at the school or service contracting
the condition.
(2) However, the chief executive must not give a direction
without first consulting with the person in charge of the school or service
and with— (a) for a direction to be given to the person in charge of a
school—the chief executive of the department that administers the
Education (General Provisions) Act 2006 and the
Education (Accreditation of Non-State Schools) Act 2017 ; or
(b) for a
direction to be given to the person in charge of an education and care
service—the chief executive of the department that administers the Education
and Care Services National Law (Queensland) ; or
(c) for a direction to be
given to the person in charge of a QEC approved service—the chief executive
of the department that administers the Education and Care Services Act 2013 .
(3) A direction must be in writing and state ways of minimising the risk of
contracting the contagious condition by children and staff at the school or
service including, for example, by— (a) preventing the sharing of eating
utensils, drinking cups, bed linen and clothing; or
(b) requiring that eating
utensils, drinking cups, bed linen, toys or other equipment be disinfected; or
(c) requiring that stated procedures for cleaning and disinfecting be
followed; or
(d) requiring the person in charge to give information to staff,
children or parents about the contagious condition including about the way it
may be treated and measures to prevent its spread.
(4) The person in charge
of the school or service must comply with a direction by the chief executive.
Penalty— Maximum penalty for subsection (4) —50 penalty units.
