PUBLIC HEALTH ACT 2005 - SECT 344
Procedure before entry
344 Procedure before entry
(1) This section applies to an emergency officer intending to enter a place to
respond to a declared public health emergency.
(2) Before entering the place,
the emergency officer must do or make a reasonable attempt to do the following
things— (a) seek an occupier’s consent to the entry;
(b) tell the
occupier the emergency officer is permitted to enter the place to respond to a
declared public health emergency;
(c) give the occupier an opportunity to
allow the emergency officer immediate entry to the place without using force.
(3) However, the emergency officer need not comply with subsection (2) if the
emergency officer believes on reasonable grounds that immediate entry to the
place is required to effectively respond to the declared public health
emergency.
