PUBLIC HEALTH ACT 2005 - SECT 417
Failure to give name or address
417 Failure to give name or address
(1) A person of whom a personal details requirement is made must comply with
the requirement, unless the person has a reasonable excuse. Penalty—
Maximum penalty—50 penalty units.
(2) A person does not commit an offence
against subsection (1) if— (a) the person was required to state the
person’s name and residential address by an authorised person who suspected
the person had committed an offence against this Act; and
(b) the person is
not proved to have committed the offence.
(3) Also, a person does not commit
an offence against subsection (1) if— (a) the person was required to state
the person’s name and residential address by an authorised person who
suspected the person was responsible for a public health risk; and
(b) a
court decides the person is not responsible for the public health risk.
