61H Obligation to notify chief executive of Legionella
(1) This section applies if the result of a prescribed test confirms the
presence of Legionella in water used by a prescribed facility.
(2) A person
in charge of the prescribed facility must, under subsection (3) , give the
chief executive a notice about the result of the test, unless the person has a
reasonable excuse. Penalty— Maximum penalty— (a) if the offence is
committed intentionally—1,000 penalty units; or
(b) otherwise—200 penalty
units.
(3) The notice must— (a) be in the approved form; and
(b) be
given to the chief executive within 1 business day after the person in charge
is notified of the result of the test; and
(c) comply with any other
requirements prescribed by regulation.
