PUBLIC HEALTH (INFECTION CONTROL FOR PERSONAL APPEARANCE SERVICES) ACT 2003 - SECT 123
Stay of operation of original decision
123 Stay of operation of original decision
(1) If an application is made for a review of an original decision, the
applicant may immediately apply, as provided under the QCAT Act , to QCAT for
a stay of the decision.
(2) QCAT may stay the decision to secure the
effectiveness of the review and any later review.
(3) The stay— (a) may be
given on conditions QCAT considers appropriate; and
(b) operates for the
period fixed by QCAT; and
(c) may be revoked or amended by QCAT.
(4) The
period of the stay must not extend past the time when the local government
that made the original decision makes a review decision about the original
decision and any later period QCAT allows the applicant to enable the
applicant to apply for a review of the review decision.
(5) An application
under subsection (1) affects the original decision, or carrying out of the
original decision, only if the original decision is stayed.
