PUBLIC INTEREST DISCLOSURE ACT 2010 - SECT 23
Disclosure in court or tribunal proceeding
23 Disclosure in court or tribunal proceeding
(1) The section applies if a person— (a) has information that the person may
disclose as a public interest disclosure to a proper authority; and
(b)
discloses the information to a court or tribunal in a proceeding in which the
information is relevant and admissible.
(2) The disclosure is taken to be a
public interest disclosure made to the court or tribunal as a proper authority
under section 15 (1) (a) (ii) .
(3) The court or tribunal may refer the
disclosure to another proper authority.
(4) Section 31 (2) to (5) applies to
a referral under subsection (3) as if the court or tribunal were a
public sector entity.
(5) The fact that a court or tribunal is treated as a
public sector entity under this Act, and therefore can be a proper authority
under section 15 (1) (a) (ii) to receive a public interest disclosure, does
not give a person a right to take a proceeding before the court or tribunal
that the person does not have apart from this Act.
