PERSONAL INJURIES PROCEEDINGS ACT 2002 - SECT 72
Offences involving fraud
72 Offences involving fraud
(1) A person must not in any way— (a) defraud or attempt to defraud a
respondent; or
(b) deliberately mislead or attempt deliberately to mislead a
respondent; or
(c) connive at conduct by another that contravenes paragraph
(a) or (b) .
Penalty— Maximum penalty—400 penalty units or 18 months
imprisonment.
(2) If conduct that constitutes an offence defined in
subsection (1) is recurrent so that, apart from this subsection, each instance
of the conduct would constitute a separate offence, 2 or more instances of the
conduct are to be taken to constitute but 1 offence committed over a period
specified in the complaint laid in relation to the conduct, and may be charged
and be dealt with on 1 complaint.
