Persons taking who are not parties
13 Persons taking who are not parties
(1) In respect of an assurance or other instrument executed after the
commencement of this Act, a person may take— (a) an immediate or other
interest in land; or
(b) the benefit of any condition, right of entry,
covenant or agreement over or respecting land;
even though the person may not
have executed the assurance or other instrument, or may not be named as a
party to the assurance or other instrument, or may not have been identified or
in existence at the date of execution of the assurance or other instrument.
(2) Such person may sue, and shall be entitled to all rights and remedies in
respect of the assurance or other instrument, as if the person had been named
as a party to and had executed the assurance or other instrument.
